Terms of Service

These terms govern your use of everlivingjewels.com and any commission you place with Everliving Jewels ("we", "us", "our"), a custom jewellery studio based in Toronto, Ontario, Canada. By using this website or commissioning a piece, you agree to these terms.

1. Our website

The content on this website — including text, designs, images, video and our educational guide — belongs to Everliving Jewels and is provided for your personal, non-commercial use. Please don't reproduce or republish it without our written permission.

Our Guide is general educational information about diamonds, settings and metals. It is not a gemological appraisal or professional advice, and individual stones and pieces vary. Decisions about a specific stone or design are made together during your consultation.

2. Consultations

Consultations are complimentary and carry no obligation. They are held over Zoom, or in person in Scarborough, Toronto by appointment.

3. The commission process

Every piece is made to order. The typical process: consultation → design and CAD renders → your written approval of the final design and quote → stone selection → crafting → delivery. Once your design is approved, crafting typically takes about 15 business days. Timelines are good-faith estimates and can occasionally shift with stone sourcing or design complexity; we keep you informed throughout.

4. Pricing and payment

• All prices are in Canadian dollars (CAD). Quotes are itemized and transparent.
• Design work begins with a $250 CAD design deposit, credited toward your final price.
• On design approval, a 50% deposit secures your commission and crafting begins.
• The balance is due before delivery or shipment of the finished piece.
• Quotes are valid for the period stated on them; diamond and metal market prices can change until your commission is secured.

5. Cancellations, changes and refunds

Because every piece is custom-made for you:

• The design deposit is non-refundable once design work has begun — it covers the design time invested, whether or not you proceed.
• If you cancel after approving the design but before crafting begins, we will refund your commission deposit less any costs already incurred (such as stones sourced specifically for your piece).
• Once crafting has begun, deposits and payments are non-refundable.
• Completed custom pieces are final sale. This does not affect our craftsmanship warranty below or any rights you have under Ontario consumer protection law.

Small design adjustments during the process are part of the journey and we accommodate them where practical; changes that materially alter the design or materials after approval may adjust the price and timeline, which we will confirm with you in writing first.

6. Heirloom and customer-supplied stones

We love giving existing stones a new life, and we handle them with the greatest care. However, stones carry inherent risk when being unset, handled or reset — including pre-existing internal flaws that are not visible until work begins. By providing your own stone you accept that Everliving Jewels is not responsible for damage arising from such inherent characteristics. We recommend having heirloom stones independently appraised and insured before work begins, and we will flag any visible concerns before touching the piece.

7. Shipping and delivery

• We offer complimentary, fully insured shipping worldwide, and complimentary hand delivery within the Greater Toronto Area.
• All shipments require signature on delivery. Risk passes to you upon delivery.
• For international orders, any customs duties, import taxes or brokerage fees are the recipient's responsibility.

8. Resizing, care and warranty

• We resize your ring to a perfect fit at no charge.
• Every piece includes an insurance appraisal. Appraisal values are estimates for insurance purposes and are not a guarantee of resale value.
• We warrant our craftsmanship: manufacturing defects will be repaired at no charge for one (1) year from delivery. This does not cover normal wear, accidental damage, loss or theft, damage caused by work performed by another jeweller, or inherent characteristics of customer-supplied stones.
• We recommend insuring your piece — your appraisal makes this straightforward with any home or specialty jewellery insurer.

9. Our designs

Design concepts, sketches and CAD files remain the intellectual property of Everliving Jewels. You own your finished piece, and we will never recreate your commissioned design identically for another client. We may photograph finished work for our portfolio and social media; if you'd prefer your piece stay private, just tell us and we won't share it.

10. Limitation of liability

To the maximum extent permitted by applicable law, Everliving Jewels' total liability arising out of or relating to a commission or your use of this website is limited to the amount you paid us for the piece concerned. We are not liable for indirect or consequential losses. Nothing in these terms limits rights that cannot be limited under Ontario consumer protection law.

11. Booking and communications

Appointment booking is provided through our scheduling platform. By booking you agree to receive appointment-related communications (confirmations and reminders). How we handle your information is described in our Privacy Policy.

12. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it. Any disputes will be resolved in the courts of Ontario.

13. Changes to these terms

We may update these terms from time to time; the version posted here applies. For commissions, the terms in effect when you place your commission apply, together with anything we confirm in writing for your specific piece.
